Motorcyclist's Own Camera Implicates Himself

Police spokesman Martin Fournel said they found a GoPro camera strapped to his motorcycle and they were able to watch footage of him breaking multiple traffic rules.

A snippet of the footage posted on the police force's Facebook page appears to show a motorcyclist weaving from lane to lane, making illegal passes.

Warrant not needed for camera in this case
The driver was fined $1,264, which Fournel said he has paid. The fine was laid based on the footage and what officers saw on the road.

Fournel said the man could also face careless driving charges.

Police do need warrants to seize footage in some instances, said Fournel, but in this case one was not needed. He said he could not give any other details.

The other motorcyclist has not been found.

I guess the moral of the story is don't film yourself driving stupidly, or better yet don't drive stupidly.

It could have ended very badly if that car had pulled out in front of him at about the 36 second mark in the footage.

I don't know how it works in Canada, but I think that that is a way of self incrimination and it would be good to know why police where able to see the recording without a court order.

I believe it comes down to this. If the camera required a search of private property, like a house, to discover, a search warrant would have been required, but since it was out in the open attached to his helmet or bike, none was required. The police here can also search a car here without a warrant if they have what is called "just cause". For example if the driver is intoxicated they can check the car for open liquor. This case is unique though in that it is the first time that someone has been convicted of a traffic violation with their own video.

Canada uses the same legal system as Britain as do other Commonwealth countries. As far as I know though there is nothing similar to the Fifth Amendment or Miranda rights though, as they exist in the US, that protect people from incriminating themselves. Judges have more flexibility in sentencing though and punishments are usually less severe and rehabilitation is stressed more for those found guilty in more minor crimes and for young offenders.

I'm just surprised that the video can even be considered evidence... It doesn't show the motorcyclist in question at all. At least in the clip posted...
